ORDER:
....Respondents This Writ Petition is filed for the following substantive relief: “to issue a writ or direction more particularly in the nature of Mandamus declaring the action of respondent No.5 in issuing notice in R.C.No.1/Co-operatives/ Anumanchipalli/2014, Dt.:Nil-10-2014 to conduct General Body Meeting of the Petitioner's society on 28-10-2014 as illegal, arbitrary, arbitrary and violative of principles of natural justice and contrary to rules and set aside the same and consequently, to set aside the appointment of respondent No.5 as person-in-charge of the petitioner's society as the same is violation of bye-laws of the petitioners' society.”
After arguing the case, Ms D.Padmavathi, learned counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition with liberty to the individual Directors to file a separate Writ Petition as, a single Director cannot represent the society in the absence of any authorisation given in his favour.
The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, WPMP.Nos.40017 and 40018 of 2014 are dismissed as infructuous.
