ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.2 to 4 in not considering the petitioner’s request for appointment as fair price shop dealer, as the legal heir of the deceased fair shop dealer of Acharlagudem, Nelakondapalli Mandal, Khammam District, as illegal and arbitrary.
On 26.09.2014, the case was adjourned as no one appeared. Even today, when the case is called, learned counsel for the petitioner is not present. However, in all fairness, learned Government Pleader for Civil Supplies (Telangana State), on instructions, submitted that as per the scheme formulated under G.O.Ms.No.4, dated 28.02.2014, the petitioner is entitled to be provided compassionate appointment in place of his deceased father.
In view of the same, the Writ Petition is disposed of by directing respondent No.3 to consider the petitioner’s representation, dated 20.05.2014, for his appointment as permanent fair price shop dealer of Acharlagudem, Nelakondapalli Mandal, Khammam District and communicate his decision to the petitioner within one month from the date of receipt of this order.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.35095 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
