Heard learned counsel for the parties and perused the record.
The petitioner was terminated while he was on training. The order of termination was ultimately set aside in Special Appeal (Defective) No. 1330 of 2013 (Anuj Yadav vs. State of U.P. and others) vide order dated 3.1.2014, passed by this Court.
It appears that petitioner had applied for leave but could not immediately join.
It is stated that subsequently in the month of April, 2015, when petitioner offered his joining, he was not allowed to resume. Various representations, made in that regard, are stated to have remained pending. This petition has been filed for a direction upon the respondents to allow the petitioner to resume his remaining Training.
While entertaining the writ petition, time was allowed to learned Standing Counsel to obtain instructions in the matter.
In this regard, learned Standing Counsel submits that the petitioner had not reported for joining and the matter had been reported to the higher authorities.
In the facts and circumstances of the present case, it would be appropriate to dispose of this petition with a direction to respondent No. 2, i.e., Deputy Inspector General of Police, Kanpur Nagar, to examine the grievance of the petitioner for being allowed to resume training on the post of Constable in terms of the order dated 3.1.2014 passed by this Court in Special Special Appeal (Defective) No. 1330 of 2013 (Anuj Yadav vs. State of U.P. and others). A decision, in this regard, shall be taken by the concerned respondent, in accordance with law, within a period of two months from the date of presentation of a certified copy of this order.
