This writ petition is inter alia directed against order dated 20.11.2018, passed by respondent no. 3/ District Magistrate, Farrukhabad in Case No.00847/2018 (Computerized Case No. D201803240000847 (State Vs. Anuj), under Section 3 of Uttar Pradesh Control of Goondas Act, 1970, P.S. Merapur, District Farrukhabad.
Learned counsel for the petitioner submits that on the ground of one criminal case, learned District Magistrate, Farrukhabad has passed the order of externment. It is further submitted that the appeal filed against that order has been admitted, but no order on the stay application was passed, which would frustrate the very purpose of the appeal.
Learned A.G.A, has opposed the arguments submitted on behalf of the petitioner and support the order impugned.
Considering all the facts and circumstances, the writ petition is finally disposed of with the direction to the learned Commissioner, Kanpur Region, Kanpur to decide the Appeal No. 00441/ 2019/ 640/9 (Computerized Case no. C2019903000000441) under Section 6 of U.P. Control of Goondas Act, 1970 as expeditiously as possible, preferably within two months from the date of production of certified copy of the order. It is further provided that no adjournment shall be granted to any of the parties unless it is required for very compelling reasons.
