List has been revised. No one has appeared on behalf of the informant- respondent no. 4 Heard Sri Neeraj Srivastava, learned counsel for the petitioners, Sri Omprakash Mishra, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 15.03.2019 registered as case crime no.0168 of 2019, under sections 363, 366 I.P.C., police station- Brahmpuri, District - Meerut.
Learned counsel for the petitioners has submitted that the accused- petitioners are the real brother and sister of the main accused Deepu, who's where about is not known. Learned counsel for the appellant has submitted that the main allegation is against Deepu, that he has enticed away the daughter of respondent no. 4, who is 21 years of age. Learned counsel for the appellant has further submitted that petitioners have no criminal history.
Learned A.G.A. opposed the prayer for quashing the FIR.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. provided they shall co-operate with the investigation of the case.
