Heard Shri Venu Gopal, learned counsel for the petitioner and Shri B.P. Singh Kacchawah, learned Standing Counsel for the State.
At the outset, learned counsel for the petitioner states that the petitioner is pressing prayer no.2, only. Prayer for installment has been made in the context of grave illness being suffered by the petitioner's wife.
In this view of the matter, the writ petition is disposed of by directing the petitioner to deposit the amount of Rs. 1,23,724/-, due by way of tax against vehicle permit no. UP/25/112/GOOD/2011/10668, in four installments. The first installment of Rs. 33,724/- shall be paid on or before 16 August 2021 and the rest amount (Rs. 90,000/-) shall be paid in three equal monthly installments of Rs. 30,000/- each, payable on 30 September 2021; 31 October 2021 and; 30 November 2021, respectively.
If the petitioner deposits the amount, as directed above, no coercive measure shall be taken against him regarding the recovery.
In case of default of the conditions as mentioned above, the present order shall stand automatically vacated and recovery proceedings shall revive from that stage.
