The instant writ petition has been filed seeking quashing of paragraph 5(iv) of the advertisement issued for inviting applications for appearing in Entrance Examination for admission to D.El.Ed. course for session 2018-19. Paragraph 5(iv) of the advertisement stipulates that result of qualifying exam declared after the last date prescribed for submitting application forms shall not be entertained. It is urged that on account of said condition, the petitioner, whose result of Graduation has yet not been declared, would not be able to submit the application.
Learned standing counsel, on instructions, states that eligibility for filing application form is contained in paragraph 4(i) of the advertisement, which stipulates that a candidate should have passed High School, Intermediate and Graduation with at least 50% marks before filing of application. Meaning thereby that a candidate is eligible only if he/she has passed the examination on or before the date, application form is submitted. It is urged that paragraph 4(i) of the advertisement is not under challenge and therefore, no relief could be granted to the petitioner.
Sri Krishnaji Khare, learned counsel appearing on behalf of petitioner states that the State Government is already in the process of examining hardship of such students. He has referred to a news paper report and states that the petitioner would represent to the State Government, so that remedial measures are taken.
Accordingly, having regard to the submissions made by learned counsel for the petitioner, this Court, without going into merits of the issue, grants liberty to the petitioner to approach the State Government with a detailed representation alongwith a certified copy of this order and in which event the State Government shall take decision in the matter in accordance with law.
