Heard Sri Siddharth Baghel, learned counsel for the petitioner and the learned Standing Counsel for the respondents.
This writ petition has been filed by the petitioner claiming grant of seniority on the post of Deputy Superintendent of Police w.e.f. date when he got eligible under the Government Order dated 7.2.2003 i.e. 3.10.2005 and also other consequential benefits. In this regard the petitioner has also moved a representation before the Respondent no.1 on 25.10.2017 which has been enclosed as Annexure-5 to the writ petition. Learned Standing Counsel for the respondents states that a decision can be taken by the respondent no.1 in this regard.
No useful purpose would be served in keeping the petition pending.
Accordingly, this writ petition is disposed of with a direction to the Respondent no.1-Principal Secretary (Home), Government of U.P., Lucknow to consider and decide the representation of the petitioner dated 25.10.2017, Anexure-5 to the writ petition, in accordance with law within a period of three months from the date of receipt of a certified copy of this order is received in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
