This anticipatory bail application under Section 438 Cr.P.C. has been moved seeking the bail of applicant-Anubhav Singh @ Anu in the event of his arrest in Case Crime No.87 of 2021, under Sections 504, 506, 307, 34 I.P.C., Police Station Colonelganj, District-Prayagraj.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material available on record.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He has committed no offence. It is further submitted that although the applicant is named in F.I.R. but he has no concerned with the present case. It is a case of no injury. He further submits that if the applicant is enlarged on anticipatory bail, he shall not misuse the liberty of bail and would co-operate with the investigation.
Learned AGA vehemently opposed the application and submitted that there is criminal history of 10 cases which have been registered earlier against the applicant except the present case.
Considering the facts and circumstances of the case, allegation levelled against the applicant and criminal history of 10 cases against the applicant, I do not find any good ground to release the applicant on anticipatory bail.
Accordingly, the anticipatory bail application is rejected.
