The petitioner is given No Objection Certificate by Vadasserikkara Grama Panchayath for constructing a residential building in Sy.No.286/4-2, in Block No.31. The petitioner wants to extract ordinary earth from the site covered by Exhibit P1 permit. In view of the Government Order produced as Exhibit P2, it is not necessary to obtain permission from Geologist for extracting ordinary earth from the site covered by the building permit. However, for the purpose of transporting the ordinary earth the petitioner requires ‘P Form’. 2. If the proposed construction is exceeds 300 square metres of commercial building, permit is required. The petitioner submits that the proposed construction is for residential building, therefore, no permit is required.

In view of the Government Order produced as Exhibit P2, the 3rd respondent shall verify the claim of the petitioner and if satisfied that the petitioner propose to construct a residential building, necessary ‘P Form’ shall be issued to the W.P.(C).No. 26911 of 2014 2 petitioner to transport ordinary earth from the site covered by Exhibit P1 permit. Needful shall be done within a period of two weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed as above.
