JUDGMENT / ORDER

Petitioner is the first accused in Crime No.308 of 2014 of the Alappuzha North Police Station for the offences punishable under Secs.452, 323, 324 and 326 r/w Sec.34 of the Indian Penal Code, apprehends arrest and has filed this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that on 06.03.2014 at about 5p.m, the petitioner and others trespassed into the barber shop of the de facto complainant and voluntarily caused hurt/grievous hurt to them with iron rod, cycle chain etc.
3. Learned counsel submits that the allegations are not true. Petitioner only tried to save the de facto complainant from the other accused. It is also submitted that the injuries suffered by the de facto complainant are minor.
4. This is a case involving trespass into the barber shop of the de facto complainant and voluntarily causing hurt to him. Having regard to the facts, the weapons allegedly used and the investigation required to be done, I am not inclined to think that the extraordinary jurisdiction could be exercised in favour of the B.A.No.3051 of 2014 2 petitioner. Petitioner, if so advised, can surrender before the investigating officer or before the Court concerned and seek bail. In case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of with the above direction.
