JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. The petitioner is the sole accused in Crime No.279/2014 of Varantharappilly Police Station registered for the offences under Section 12 of the Protection of Children from Sexual Offences Act 2012.
3. The allegation against him is that he pressed the private parts of a boy aged 12 years at a public place. It is submitted that the allegation is false, which is evident from the fact that the child had no such case and the police was informed of the incident only after much delay.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The 1st informant has entered appearance through a counsel.
She has no objection to bail being granted to the petitioner. It is true that there was much delay in informing the police also. Petitioner is aged 61. In the said circumstances, I am inclined to grant the prayer of the petitioner.
In the result, this Bail application is allowed with the following conditions:
1) The petitioner shall be released on bail on his executing a bond for Rs.20,000/-.(Rupees Twenty Thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this B.A. NO.2750 OF 2014 2 case.
2) He shall appear before the Investigating Officer for interrogation if he is so required by him in writing.
3) He shall not destroy or tamper with evidence.
This order is not applicable if the petitioner chooses to surrender before the Magistrate concerned and in such case the learned Magistrate may take appropriate action in accordance with the law.
