Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State-respondent and Sri Ayank Mishra, learned counsel appearing for respondents no.1 to 5.
Against the order dated 28.4.2017 the petitioner has filed departmental appeal, which is stated to be pending and during the pendency of such appeal, recovery citation has been issued on 31.7.2018.
Without going into the merits of the case, the writ petition is disposed of with the observation/direction to the Chief Engineer- respondent no.5 to consider and decide the appeal filed by the petitioner, as far as possible, within a period of two months from the date a certified copy of this order is presented before the authority concerned.
