Order on Crl. Misc. Delay Condonation Application No. 5 of 2021 and Crl. Misc. Restoration Application No. 6 of 2021 Heard learned counsel for the applicant.
Cause shown in the affidavit accompanying the delay condonation application as well as restoration application is sufficient. Both the applications are allowed. The order dated 15.11.2021 dismissing the writ petition as having become infructuous, is recalled. The writ petition is restored to its original number.

This writ petition has been filed for mandamus directing the respondent concerned to close the history sheet No. 5 B dated 22.8.2020 against the petitioner opened at Police Station New Agra and now transferred to Police Station Kamla Nagar, District Agra.
Learned AGA very fairly states that in case an appropriate application is moved by the petitioner before the competent authority for redressal of his grievance, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally asking the petitioner to move an appropriate application before the competent authority ventilating his grievance within two weeks from today and in case any such application is being preferred definitely the same would be decided strictly in accordance with law within six weeks thereafter.
