JUDGMENT / ORDER

Heard learned counsel for the applicant, learned AGA for the State and perused the record.
Learned counsel for the applicant submitted that showing the 140 gm. Powder, and 10 tablets of Diazepam applicant was falsely implicated under the N.D.P.S. Act. There is no criminal history of the applicant. He further submitted that applicant will not misuse the liberty of bail and he will not indulge in any such activities, if he is released on bail, hence applicant is entitled for bail. In the present case, the applicant is in jail since 08.5.2010.
In view of the above, without expressing any opinion on merit, let the applicant Anshu Raidash @ Rajesh be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of court concerned in Case Crime No.293/10, under Section 21/22 N.D.P.S. Act, P.S. G.R.P., District Kanpur Nagar.
