This writ petition has been filed, inter alia, for the following relief;
"(a) Issue a writ, order or direction in the nature of mandamus directing the District Magistrate, Meerut/Additional District Magistrate, (Finance & Revenue) District Varansi (respondent no. 2) to decide/dispose of the recall application pending in case Case No. 44 of 2017-18 (Authorized Officer, Union Bank of India, branch Visheswarganj, Varanasi) filed under section 14 of the SARFAESI Act."
Learned counsel for the petitioner has prayed that the Respondent No. 2, District Magistrate, Meerut may be directed to dispose of the recall application pending before it within a stipulated period of time.
Heard learned counsel for the petitioner, learned Standing Counsel appearing on behalf of the State, Ms. Rupal Agarwal, learned Counsel holding brief of Sri Ashish Agrawal, learned counsel for the respondent Bank and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a request to the Respondent No. 2, District Magistrate, Meerut to consider and decide the recall application pending before it after giving an opportunity of hearing to the petitioner in Case No. 44 of 2017-18 (Authorized Officer, Union Bank of India, branch Visheswarganj, Varanasi) filed under section 14 of the SARFAESI Act in accordance with law expeditiously preferably within a period of three weeks from the date of receipt of a certified copy of this order.
