JUDGMENT / ORDER

The petitioners herein are the three accused in C.C No.2400/13 of the Judicial First Class Magistrate Court, Karunagappally. Crime in the said case was registered under Sections 341, 324 r/w 34 of IPC on the complaint of one Rashid. The petitioners now seek orders quashing the prosecution on the ground that they and Rashid have come to terms amicably out of court. The de facto complainant Rashid is the second respondent herein. He has filed affidavit to the effect that he has settled the dispute with the accused and he has no grievance or complaint now. I am well satisfied that there is a real settlement, and continuance of prosecution in such a situation will not serve any purpose, other than wasting the precious time of the court. In the result, this petition is allowed. The prosecution as against the petitioners in C.C No.2400/13 of the Judicial First Class Magistrate Court, Karunagappally, will stand quashed under section 482 Cr.P.C. Accordingly, the petitioners will stand released from prosecution, and the bail bond, if any, executed by them will stand discharged.
