The present criminal revision has been filed against the judgement and order dated 28.3.1992, passed by A.C.J.M. III, Jaunpur in Case No. 495 of 1990 (Smt. Jamila Begum Vs. Ansar Ahmad), whereby the application moved by the respondent under Section 125 Cr.P.C. was partially converted under Section 3 of the Muslim Women (Protection of Rights on Divorce) Act, 1986; the revisionist was directed to pay Rs.14,560/ to the respondent immediately towards mehr, iddat etc. and under Section 125 Cr.P.C., for the purposes of maintenance of children, revisionist was directed to pay Rs.150/- per month each (Total Rs.300/-) from the date of application.
Brief facts of the case are that marriage between the revisionist- husband and respondent-wife was dissolved; it is admitted case that two sons were borne out of their wedlock; both the children are living with respondent-wife; respondent moved an application under Section 125 Cr.P.C. for maintenance. The said application was decided by the impugned order dated 28.3.1992 in favour of respondent after considering the material available on record. Against the aforesaid order, revisionist has filed this revision.
I have perused the impugned order. This Court finds no illegality, impropriety, material irregularity or jurisdictional error in the impugned order. No interference is called for. The present revision lacks merit and is liable to be dismissed.
The revision is accordingly dismissed. Interim order, if any, stands vacated.
Office is directed to send a copy of this order to the court concerned immediately.
