Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Anoop Yadav who is involved in Case Crime No. 258 of 2018, under Sections 395, 397, 412 I.P.C., Police Station-Kotwali Lalitpur, District-Lalitpur.
As per prosecution version, applicant Anoop Yadav and co-accused Banti Raja, Gagan Panth, Gahla @ Pushpendra, Sandip Ahirwar, Chhotu, Devendra and Shanu had looted Rs. 1,00,000/- from the informant on 11.3.2018 at about 6:00 PM.
Learned counsel for the applicant contended that on 12.3.2018, co- accused Gagan Panth was arrested by the police and on the basis of his confession before the police, a first information report has been lodged naming the applicant. On 18.3.2018, it is alleged that applicant was arrested by the police by showing recovery of Rs. 14,000/-. On the basis of arrest on 18.3.2018, he has been made accused in six other case. Applicant has no criminal antecedent before this arrest.
Learned A.G.A., has opposed the prayer for bail and admitted this fact that there is criminal history of six cases against the applicant.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Anoop Yadav, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
