Heard Mr. Nanavati, learned advocate for the petitioner.
Mr.
Nanavati, learned advocate for the petitioner, has submitted that present petition is exactly identical to the writ petition being Special Civil Application No.5916 of 2012 and the issues as well as subject involved in both matters are similar and identical. He has also submitted that, actually, present petitioner was one of the petitioners in Special Civil Application No.5916 of 2012, however, since separate petitions in respect of each petitioners were directed to be filed, present petition has been taken out in light of the order dated 24.4.2012 passed in Special Civil Application No.5916 of 2012.
He also submitted that since present petition is exactly identical to Special Civil Application No.5916 of 2012, similar order may be passed in present petition as has been passed on 24.4.2012 in Special Civil Application No.5916 of 2012.
In view of the aforesaid submission, below mentioned order is passed:-
Notice returnable on 22.6.2012.
Until then, the respondents will not make any recovery in pursuance of the communication dated 7.4.2012 (page-17) of present petition.
