JUDGMENT / ORDER

The limited prayer in this original petition is that there may a direction to the Munsiff Court, Alathur to take up and dispose of O.S.No.40/2013 pending before the said court. 2. The petitioner points out that he has made certain constructions in the suit property and he is precluded from making further constructions as per Ext.P3 order issued by this Court and that he is given liberty to approach the Munsiff Court for further orders. The petitioner apprehends that that will only further drag on the suit since the order being sought is at an interlocutory stage. The petitioner feels that it will be only proper for him to pray to this Court that there may be a direction to dispose of the suit itself so that there will be a finality to the right of the parties.
3. After having heard the learned counsel for the petitioner, the prayer seems to be just and reasonable.

4. In the light of the order that is proposed to be passed, it is felt that notice to the respondent is unnecessary.
Hence this petition is allowed and there will be a direction to the Munsiff Court, Alathur to take up O.S.No.40/2013 and dispose of it in accordance with law at the earliest, at any rate, within a period of four months from the date of receipt of a copy of this judgment provided the suit is ripe for trial.
