Heard Sri Ajay Kumar Jagdish, learned counsel for the petitioner, learned standing counsel for respondent nos.1 and 2 and Sri R.P. Pandey, for respondent no.3.
The contention of the petitioner is that respondent bank had filed the proceedings before the Debts Recovery Tribunal, Dehradun and he has received a notice/order dated 4.1.2019. Similarly a recovery citation dated 30.11.2018 has also been issued.
Sri R.P. Pandey, learned counsel for the bank places on record the instructions received by him from respondent bank, that the bank has withdrawn the recovery certificate dated 29.10.2018 and will be proceeding only with the matter pending before the Debts Recovery Tribunal, Dehradun.
In view of the submissions so made by learned counsel for the bank, the writ petition has become infructuous.
The writ petition is dismissed as having become infructuous.
