Heard learned counsel the applicant and learned A.G.A.
The applicant, by means of this application under Section 482 Cr.P.C., has invoked the inherent jurisdiction of this Court with a prayer to quash the non-bailable warrant order dated 27.9.2018 to 13.11.2018 passed by Additional District Judge, Court No. 15, Agra in Session Trial No. 161 of 2018 (State Vs. Anoop Sharma) arising out of Case Crime No. 121 of 2017, under Sections 436 IPC, Police Station Chatta, District Agra by which they have issued non bailable warrant against the applicant for enforcing his appearance before him in the aforementioned case.
Learned counsel for the applicant states that though he was bailed out by the court, but for the reasons beyond his control, he could not participate in the trial since 27.09.2018 as mentioned in Para 7 of the application. He wants to participate in the trial and is willing to render all possible co- operation in expeditious conclusion of the trial.
After having considered the submissions made by the learned counsel for the applicant and perused the impugned order as well as the other materials brought on record, without expressing any opinion on the merits of the case, I dispose of this application with a direction that in case the applicant moves an application with the prayer for cancelling the non- bailable warrants issued against him releasing him on his furnishing fresh bail bonds before the court below within three weeks from today along with the certified copy of this order, in that case the concerned court shall pass appropriate order thereon within a further period of one week. For a period of four weeks from today, no coercive action shall be taken against the applicant in the aforesaid case.
The trial court is directed to take a written undertaking to the effect from the applicants that they would sought no adjournments and render all possible co-operation in expeditious disposed of the trial. The trial court is expected to speed up the trial and make all possible endeavour to conclude the trial within nine months, if there is no other legal impediment.
Registry is directed to communicate this order to the concerned court for necessary compliance.
