Heard Sri Dinesh Pathak, learned counsel for the petitioner, Sri Kartikeya Saran, learned counsel for the respondents no.1, 2 and 3 and Sri Satish Kumar Rai, learned counsel appearing for the respondent no.4.
The petitioner has preferred this writ petition seeking a direction upon the respondents no.1, 2 and 3 to take action and cancel the lease of Bungalow No.44 situate in Cantonment Board, Varanasi executed in favour of respondents no.5 and 6.
The petitioner is not in any way personally aggrieved by the grant of lease to the said respondents. More-over the lease was granted in the year 1937 and the petitioner is raising grievance in that regard today in the year 2019. The petitioner has not filed this petition in public interest rather the petition in public interest filed by him has already been dismissed vide order dated 10.5.2019.
In view of the aforesaid facts and circumstances, in our opinion the petitioner has no locus to maintain this writ petition as he is not the person aggrieved.
The writ petition is dismissed with cost.
