Heard Shri Anand Prakash Srivastava, learned counsel for the petitioners and learned Standing Counsel for the State - respondents.
An appeal preferred by the petitioner under section 28-A(4) of the Uttar Pradesh Urban Planning & Development Act, 1973 is reported to be pending before the Chairman, Varanasi Development Authority, Varanasi/Appellate Authority, which has not been disposed of till date.
Learned Standing Counsel submits that no useful purpose would be served by keeping the matter pending, same be disposed of by giving appropriate direction to the respondent concerned.
This writ petition is disposed of with the direction to the Chairman, Varanasi Development Authority, Varanasi/Appellate Authority to decide the petitioner's pending appeal by a reasoned and speaking order after hearing the parties concerned, as expeditiously as possible, preferably, within six weeks from the date of production of copy of this order, in accordance with law.
