JUDGMENT / ORDER

The case has been taken up through Video Conferencing, Heard learned counsel for petitioner(s), learned A.G.A. and perused the record.
By means of present writ petition, the petitioner(s) has prayed for quashing of impugned First Information Report lodged at F.I.R. No. 110 of 2021 under Section 2/3 U.P. Gangster & Prevention of Anti Social Activities Act, 1986, P.S. Salon, District - Raebareli.
Learned counsel for petitioner(s) submits that the impugned F.I.R.has been registered only to harass the petitioner(s) with oblique motive and purpose as there are only two cases against petitioner(s) in the gang chart in which petitioner(s) has already been granted bail. In this regard, reliance has been placed on the averments as made in paragraph no. 6 & 7 of the writ petition.
After hearing learned counsel for parties and going through the record, however, without expressing any opinion on the merits of the case, the writ petition is disposed of with the observations that till filling of the police report under Section 173(2) Cr.P.C., or till credible evidence is found, whichever is earlier, petitioner(s) shall not be arrested in connection with the aforesaid F.I.R. number. However, the petitioner(s) will co-operate with the investigation.
