Petitioner has scored 387.2 marks consequent upon an application made for appointment to the post of Constable in U.P. Police. Petitioner appears to be a scheduled caste candidate, but benefit of such category has been denied to him apparently for the reason that in the online application form petitioner has mentioned his category as OBC Non creamylayer.
Learned counsel for the petitioner submits that since petitioner is a scheduled caste candidate, as such, his candidature ought to be considered in his category.
Petition is opposed by learned Standing Counsel by contending that the process of recruitment was online and all such details had to be furnished on the online application form by the candidates himself. It is stated that in the online application form petitioner has mentioned his status as OBC Non Creamylayer, and as petitioner has failed to demonstrate his status as OBC, therefore, he was treated as unreserved category candidate. Submission is that petitioner has not indicated his status in the online application form as scheduled caste, and therefore, he has denied such benefits.
The Court is apprised that more than 22 lacs candidates applied for nearly 33000 posts of Constable and the entire process was online, and therefore, the authorities have restricted consideration of candidature only on the basis of disclosure made in the online application itself. Clause 6.4 of the advertisement specifically provides that details furnished in the online application cannot be permitted to be corrected.
In such circumstances, no relief can be granted to the petitioner. Writ petition is, accordingly, dismissed.
