Heard Mohd. Samiuzzaman Khan, learned counsel for the petitioner, Sri Archana Singh, learned counsel for the respondent no.4 and the learned Standing Counsel for the respondents no. 1 to 3.
The petitioner in the writ petition is seeking quashing of the demand notice dated 10.01.2019 which has been issued by the respondent no.4 to the petitioner under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (for short 'SARFAESI Act, 2002').
In our opinion, this is a frivolous and an ill advised petition since, the petitioner has a remedy of filing his objections to the said notice under Sub-Section (3A) of Section 13 of the SARFAESI Act, 2002.
The writ petition is accordingly dismissed.
