High Court Of Judicature at Allahabad|24 August, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 19583 of 2001 Petitioner :- Anokhe Lal Respondent :- Joint Director of Education & Others Counsel for Petitioner :- A.K. Goyal,Omvir Singh Rajpoot Counsel for Respondent :- C.S.C.,Ashish Mohan Srivastava
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner to press this writ petition. Learned Standing Counsel is present for respondents.
2. By means of the present writ petition, petitioner has sought following reliefs:
"i. issue a writ, order or direction in then nature of certiorari calling for the record of the case and to quash the impugned order dated 3.3.2001 (Annexure No.6 to the writ petition) passed by Respondent No.1 and the consequential impugned orders dated 21.3.2001 & 29.3.2001 (Annexure No.7 & 8 to the writ petition) passed by Respondents No.2 & 3 respectively.
ii. issue a writ, order or direction in the nature of mandamus commanding the Respondents not to interfere in the working of the petitioner as Lecturer (Hindi) and to pay salary and other consequential benefits of the post of Lecturer (Hindi) to the petitioner as and when fall due regularly.
iii. issue a writ, order or direction in the nature of ad interim mandamus commanding the Respondents not to interfere in the working of the petitioner as Lecturer (Hindi) and to pay salary and other consequential benefits of the post of Lecturer (Hindi) to the petitioner as and when fall due regularly."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
6. Sri Ashish Mohan Srivastava, Advocate, is present for respondent 3.
