Today, Advocates are abstaining from judicial work. Learned State Counsel appearing on behalf of the respondent is present.
The writ petition has been filed with the following reliefs:
"(I) Direct the respondent no.1 to decide Suit No. 845 of 2016 (Annu Vs. Pooja) under section 9 of the Hindu Marriage Act, pending in the court of Additional Principal Judge, Family Court, Fast Track Court, Court No.1, Varanasi, within stipulated period in accordance with law.
(II) Issue any other writ, order or direction in favour of the petitioner, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case."
I have perused the paper book.
From the perusal of the paper book, it reflects that petitioner filed a suit under section 9 of the Hindu Marriage Act for restitution of conjugal rights in the court of Family Judge, District Varanasi on 13.07.2016. Since the date of institution, so many dates have been fixed by the court below but the matter was adjourned on every date either one pretext or the other, hence this petition for suitable direction to the court below to decide the suit expeditiously.
In view of the facts and circumstances stated above, this writ petition is disposed of with direction to Additional Principal Judge, Family Court, Fast Track Court, Court No.1, Varanasi to decide the Suit No. 845 of 2016 (Annu Vs. Pooja) under section 9 of the Hindu Marriage Act, expeditiously, in accordance with law, preferably within a period of six months from the date a certified copy of this order is produced before him.
