JUDGMENT / ORDER

This is a petition filed under Section 24 of the Code of Civil Procedure seeking to have O.P.No.1816/2014 pending before the Family Court, Ernakulam transferred to Family Court, Thiruvananthapuram. 2. Suffice to say that, the marital relationship between the petitioner and the respondent became bitter and both of them instituted proceedings against each other. The petitioner instituted O.P.No.572/2014 before the Family Court, Thiruvananthapuram for dissolution of marriage. The respondent in turn instituted O.P.No.1816/2014 before the Family Court, Ernakulam seeking restitution of conjugal rights.
3. The petitioner points out that apart from the difficulty to attend the case at Ernakulam, she is also facing financial difficulties. It is also pointed out that common issues arise for consideration and it will be only proper that both the matters are T.P.(C) No.607/2014 2 decided by the same court.
4. Though the respondent was served with notice, there is no appearance for him.
5. Since there is no objection on the part of the respondent and also since it is found that the reason for transfer is genuine, it is felt that the relief can be granted to the petitioner.
In the result, this petition is allowed and O.P.No.1816/2014 pending before the Family Court, Ernakulam shall stand transferred to Family Court, Thiruvananthapuram.
