Ramendar Nanjungud S/o. N.R. Rama Rao, Aged about 47 years, R/at No.647, 7th Block, Jayanagar, Bangalore – 560 082. ….Respondent **** This civil revision petition is filed under Section 115 of Code of Civil Procedure praying to a) allow this revision petition by setting aside impugned order dated: 18.01.2014 passed by the VI Additional Principal Judge, Family Court, Bangalore in M.C.No.1873/2009 on I.A.No.06 and to consequently dismiss MC.No.1873/2009 as lacking territorial jurisdiction. b) to grant such other relief/s as this Hon’ble Court may deem fit to grant in the circumstances of the case in the interest of justice.
This petition coming on for Orders this day, the court made the following:
ORDER Learned counsel for the petitioner has filed a memo for withdrawal of revision petition, wherein it is stated that in W.P.No.4640/2014 it was observed that since the marriage between the parties has already been dissolved by a decree of divorce, as such parallel proceedings before the Family Court, Bengaluru cannot continue. Liberty was granted to the petitioner to file necessary application before the Family Court, Bengaluru, regarding maintainability of the divorce proceedings in India.
2. In view of the submission of learned counsel, the memo is placed on record.
3. The revision petition is dismissed as withdrawn, reserving liberty to challenge the order passed by the Family Court, Bengaluru, if occasion arises.
