Respondent Criminal Original Petition filed under Section 482 Cr.P.C. to quash the complaint in CC No.3814 of 2016 on the file of the Fast Track Court No.II, Allikulam, Chennai – 600 003 so far as the petitioner is concerned.
For Petitioner : Mr.P.S.Baskar For Respondent : Mr.R.Manickavel ORDER Challenging the criminal proceedings in CC No.3814 of 2016 pending on the file of the Fast Track Court No.II, Allikulam, Chennai against the petitioner herein, this Criminal Original Petition has been filed.
2. According to the petitioner/A2, the respondent herein has filed a complaint arraying her husband and her as accused, for the offences punishable under Sections 138 and 142 of the Negotiable Instruments Act, before the learned V Metropolitan Magistrate, Egmore, Chennai. The said complaint was taken on file as CC No.3814 of 2016 and the same was subsequently transferred to the Fast Track Court No.II, Allikulam, Chennai. Pending trial, the petitioner has come up with the present petition for quashment of the same.
3. Today, when the matter was taken up for consideration, learned counsel for the respondent, on instructions, submitted that the respondent is giving up the claim made against the petitioner/A2 herein.
4. The said submission made by the learned counsel for the respondent is recorded. Insofar as the first accused is concerned, the trial Court is directed to complete the trial and dispose of the case in CC No.3814 of 2016 pending on its file, on merits and in accordance with law, as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order.
5. Accordingly, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed.
