Respondent/Complainant COUNSEL FOR THE PETITIONERS: Sri Eerla Satish Kumar COUNSEL FOR THE RESPONDENT : The Additional Public Prosecutor Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and grounds filed herein, the High Court may be pleased to enlarge the petitioners/Accused Nos. 1 to 6, 16 to 19, 21 & 22 on bail in Crime No. 185 of 2013 of T. Sundupalli Police Station, Kadapa District.
THE COURT MADE THE FOLLOWING ORDER “Heard both sides.
The petitioners are A1 to A6, A16 to A19, A21 and A22. They seek for grant of bail. They are charged for the offences punishable under Sections 147, 148, 332, 353, 307 read with 149 IPC and 29(A) (i) of Andhra Pradesh Forest Act and rule 3 of Andhra Pradesh Red Sandal Wood Transits Act and Section 3 of PDPP Act and Section 5, 55(2) and 58 of Biodiversity Act. The petitioners are in judicial custody since 29.12.2013. It is reported that the investigation in this case has been completed and charge sheet has been filed.
Taking into consideration the above circumstances, I consider it appropriate to enlarge the petitioners on bail.
Hence, this Petition is allowed. The petitioners are directed to be enlarged on bail on their executing a personal bond for Rs.10,000/-
(Rupees Ten Thousand Only) each with two sureties in a like sum each to the satisfaction of the learned Additional Judicial I Class Magistrate, Rayachoty, Kadapa District.”
