ORDER: (per the Hon’ble Sri Justice Sanjay Kumar)
The grievance of the petitioner falls within a short- compass. He was granted environmental clearance for extraction of sand from his patta lands. However, he was granted permission by the State only on 22.01.2014 to commence quarrying operations and therefore sought a clarification under his representation dated 15.11.2014 as to whether the period of one year relating to the environmental clearance can be reckoned from the date of such permission. Despite receipt of the said representation dated 15.11.2014, the second respondent did not pass appropriate orders thereon in accordance with law. Hence, this Writ Petition.
We are of the opinion that the issue raised in this writ petition does not warrant adjudication on merits by inviting counter-affidavits. Learned Assistant Solicitor General for India, appearing for the respondents, agrees that the writ petition may be disposed of with suitable directions.
The writ petition is accordingly disposed of directing the second respondent to pass appropriate orders in accordance with law on the representation dated 15.11.2014 filed by the petitioner and issue necessary clarification taking into account the notification dated 13.03.2013 issued by the Union of India. This exercise shall be completed expeditiously and in any event, not later than three weeks from date.
Pending miscellaneous petitions, if any, shall also stand closed. No costs.
