This Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the first respondent to dispose of the representation of the petitioner, dated 26.08.2008, presented by the petitioner before the first respondent.
2. From the records available before this Court, it is found that the revision petition filed by the petitioner, on 26.08.2008, had been returned, for compliance, on 06.01.2009. The petitioner had stated that the defects pointed out by the office of the District Collector, Nagercoil, Kanyakumari District, by the communication, dated 06.01.2009, had already been complied with, as seen from the petitioner's representation, dated 06.02.2009, addressed to the first respondent.
3. Even though the number of the revision petitition had not been furnished by the petitioner, the learned counsel for the petitioner had submitted that it would suffice, if the first respondent is directed to dispose of the representation of the petitioner after numbering the same, on merits and in accordance with law, within a specified period.
4. Mr.Pala Ramasamy, the learned Special Government Pleader, appearing on behalf of the first respondent, did not have any objection for such an order being passed by this Court.
5. In view of the submissions made by the learned counsels appearing on either side, without going into the merits of the case, the first respondent is directed to dispose of the revision petition filed by the petitioner, dated 26.08.2008, after the petitioner complies with the necessary requirements and after the revision petition is numbered, on merits and in accordance with law, within a period of 12 weeks, from the date of receipt of a copy of this order, after giving an opportunity of hearing to the petitioner, as well as to the other parties concerned. The Petitioner is directed to furnish a copy of the revision petition, dated:26.08.2008, along with a copy of this order, to the first respondent.
6. With the above directions, the Writ Petition is disposed of. No costs.
