Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 287 of 2015, under Sections 302 and 307 IPC, P.S. Cantt. District Allahabad, is seeking enlargement on bail during the trial.
Learned counsel for the applicant submitted that on the similar allegation co-accused Raju Pasi was acquitted by learned Additional Sessions Judge, Court No.15, Allahabad in S.T. No. 224 of 2016 vide judgment dated 17.06.2017. It is contended by learned counsel for the applicant that the applicant identically placed in that event I am not inclined to release the applicant on bail.
After having heard the submissions advanced by learned counsel for the parties and perused the material brought on record. I am not inclined to enlarge the applicant on bail at this stage of trial, accordingly, the prayer for bail is hereby refused.
However considering the peculiar facts and circumstances of the case the trial court is directed to conclude the trial of the applicant by 31.12.2018 without granting unnecessary adjournments to either of the parties provided the applicant full cooperation in early disposal of the trial.
Subject to aforesaid direction, this application is disposed of.
