Sri K.S. Kushwaha has put in appearance on behalf of respondent-Commission. Instructions supplied by him are taken on record.
By means of this present writ petition, petitioner seeks a writ of mandamus commanding the respondent-Commission to consider objection of the petitioner with regard to question no.55 of Booklet Series 'A' and prepare a fresh select list by awarding marks of the said question to the petitioner.
On a query made by this Court, learned counsel for the petitioner informs that the written examinations, with respect to which, the question no.55 of Booklet Series 'A' has been challenged in the present petition, was conducted on 21.2.2016. However, it is submitted that the said selection has not become final and a writ petition no. 13646 of 2017 challenging the said selection is pending consideration before this Court.
In rebuttal, learned counsel for the respondent-Commission submits that selection on the post of Gram Punchayat Adhikari pursuant to the examination held on 21.2.2016 has become final, with the declaration of final select list on 24.12.2016 and appointment letters have been issued to the candidates, who qualified to the final select list.
With reference to the written instructions supplied today, it is further submitted by Sri K.S. Kushwaha that the question no. 55 of Booklet Series 'A', which is sought to be challenged in the present petition, had been re-examined by the Committee, constituted by the Commission on the objections raised by the candidates regarding correctness of questions/key answers.
The said question was found incorrect and as such, one mark (which was carried by the said question) had been allotted to all candidate across the board.
In view of above noted submissions, it is more apparent that the grievances being raised by the present petitioner does not survive. Moreover, after a period of two years of the conclusion of the selection process there is no occasion to entertain the writ petition.
For the above noted reasons, the writ petition is dismissed.
