Heard learned counsel for the petitioner.
In view of the order, which is proposed to be passed today, notices need not go to the private respondent.
The petitioner has approached this Court with the prayer to set aside the order dated 24.02.2018 passed by Additional Judge (Small Cause Court), Varanasi, whereby, the issue no.7 has been decided against the first defendant-petitioner.
The Court has proceeded to peruse the record in question and finds that the order impugned dated 24.02.2018 the petitioner has got efficacious alternate remedy before the Higher Forum but instead of availing the same, the petitioner has directly approached this Court and as such, no relief, as has been asked for, can be accorded to the petitioner under Article 227 of Constitution of India.
Accordingly, the writ petition is dismissed on the ground of alternate remedy. Certified copy annexed alongwith present writ petition be returned to the counsel for the petitioner but definitely after placing photo copy of the same on record.
