Sri Arvind Kumar, learned counsel for the respondent no.4 is not present though the matter has been called out in the revised list.
Heard Sri Sukrampal, learned counsel for the petitioners, Sri Irshad Hussain, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed with the prayer to quash the F.I.R. dated 22.5.2019, registered as Case Crime No.371 of 2019, u/s 323, 504, 506, 363, 380 IPC, P.S. Baraut, district Baghpat.
Learned counsel for the petitioners submits that the victim-petitioner no.4 has voluntarily eloped with petitioner no.1 and she is also living with petitioner no.1. As per medical report, the petitioner no.4 is aged about 17 years of age. There appears to be no document regarding her academic record. In her statement u/s 164 Cr.P.C., she has stated that she has eloped with petitioner no.1 on her own sweet-will as her father was compelling her to marry with another person.
Learned A.G.A. opposed the prayer for quashing of the FIR.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
