Heard learned counsel for the petitioner and Sri Rajesh Mishra, learned A.G.A. appearing for the State.
The only prayer made in the writ petition is to issue a writ, order or direction in the nature of mandamus directing the respondent no. 2- Commissioner Azamgarh Region, Azamgarh to decide the stay application of Appeal No. NIL dated 11.4.2019, U/s 6(1) of U.P. Goonda Act.
Having heard the learned counsel for the parties and keeping in view the the only prayer made in the writ petition, the present writ petition is disposed of with a direction to respondent no. 2 - Commissioner Azamgarh Region, Azamgarh to decide the stay application filed by the petitioner along with the Appeal No. NIL dated 11.4.2019 within a period of two months from the date of production of certified copy of this order produced before him by means of a reasoned and speaking order.
It is directed that till the disposal of the said stay application and appeal, no coercive action shall be taken against the petitioner.
It is made clear that in case the stay application has already been decided, the present order will not be given effect to.
