Leave to Appeal Application no. 2 of 2021 is taken up.
The appellants seek leave to appeal against the order dated 17.03.2021 passed in Writ A. No. 29665 of 2015 (Vinit Kumar and 4 others vs. The Registrar General High Court of Judicature at Allahabad). It is contented that though the appellants were not impleaded as a party, however, notice were served upon them informing them about the pendency of Writ A No. 29665 of 2015. It is urged that as they are adversely affected by the order passed by the learned Single Judge, they seek leave to file present Special Appeal.
Considered the submission. Application is allowed.
The appellants are granted leave to prosecute the special appeal.
Objections raised by the office are ignored. Office to allot a regular number to the appeal.
The special appeal take exception to an order dated 17.03.2021 passed in Writ A No. 29665 of 2015. The issue raised in present appeal is already answered by us in Special Appeal Defective No. 318 of 2021 (Nishant Yadav And 28 Others Vs. The Registrar General Allahabad High Court Allahabad Of U.P. And 5 Others) and similar matters decided on 12.04.2021 wherein we have set aside the impugned order dated 17.03.2021.
In view whereof, the present appeal is also disposed of in the same terms as of the order dated 12.04.2021 passed in Special Appeal Defective No. 318 of 2021.
Let a copy of the order passed in Special Appeal Defective no. 318 of 2021 be placed on record of this appeal.
