1. Heard learned counsel for petitioner and learned Standing Counsel for State-respondents.
2. This petition is misconceived. Admittedly, an award has been made by Motor Accident Claim Tribunal in Motor Accident Claim Petition No. 3 of 2013, vide Judgment and award dated 30.11.2016 passed by Sri Manraj Singh, Motor Accident Claim Tribunal/Additional District Judge, Court No. 9, Fatehpur. Since amount of said award made by court below has not been paid, therefore, recovery proceedings have been initiated. For stay of aforesaid recovery, this petition is not maintainable particularly when First Appeal From Order No. 444 of 2017 against said award is pending.
3. Writ petition is, accordingly, dismissed.
