Heard the learned counsel for the applicant and the learned AGA for the State.
This application has been filed seeking to quash the non- bailable warrants dated 07.04.2018 in Case No.15936 of 2017 (State Vs. Ankit Kumar) arising out of Case Crime No.56 of 2017, under Sections 376, 506 IPC PS Sadar Bazar, District Saharanpur.
The applicant had earlier challenged the entire proceedings of the aforesaid case through an application under Section 482 CrPC being Application (under Section 482 CrPC) No.41396 of 2017 where this Court refused to quash the proceedings and dismissed the application by the order dated 12.12.2017. Now faced with coercive processes the applicant has come up seeking to quash the non-bailable warrants issued in the case.
The order issuing non-bailable warrants dated 07.04.2018 is not a substantive order but is a mere process. Also, the said process is not challenged on any substantive ground as such the same cannot be interfered with.
