No one appears on behalf of petitioners even in the revised call.
However, Sri Vinod Kant Srivastava, learned Additional Advocate General is present and filed instructions alongwith statement of petitioner No. 1 Ankita Pandey as directed in terms of the order dated 17.09.2021 which is taken on record.
This habeas corpus petition has been filed by the corpus-Ankita Pandey through her husband i.e.Akash Kumar Maurya for production of petitioner, who is in illegal detention of respondent no.4.
Corpus Ankita Pandey in her statement recorded before S.H.O., PS. Handia, District Prayagraj has stated that she is residing with her family on her own sweet will without any compulsion and coercion and expressed her desire to live with her family in future too.
Considering the aforesaid statement of corpus, arguments advanced by Sri Vinod Kant Srivastava, learned Additional Aadvocate General and after perusal of the record, this Court finds that petitioner no.2 Akash Kumar Maurya wants to defame the image of Ankita Pandey in the society and only with the said intention the present petition has been filed before this Court so that he may be able to succeed in his plan to anyhow get the custody of Ankita Pandey whereas the girl refused any relation with one Akash Kumar Maurya before this Court. The action of Akash Kumar Maurya is illegal and against the norms of society in which we are living.
In view of the aforesaid, this petition is hereby dismissed.
