Heard learned counsel for the petitioner and learned Standing Counsel for the respondent.
By means of this petition, the petitioner has challenged the order dated 12.09.2018 by which the prayer of the petitioner to extend the interim injunction, has been rejected.
From the records, it appears that the interim injunction was obtained ex parte in the year 2008 and was extended up to the year 2011. Thereafter it was not extended. Ultimately, an application for its extension was moved in the year 2018, which came to be rejected by order dated 12.09.2018.
As the Application 6-C on which interim injunction was passed is stated to be pending before the court below, the petitioner may approach the court concerned for disposal of the Application 6-C. In case, other side is already represented in the suit proceedings, the court concerned shall address the said application and, after hearing both sides, pass appropriate order in accordance with law, preferably, within a period of two months from the date of filing of certified copy of this order.
With the aforesaid direction, the petition is disposed of.
