Heard learned counsel for the petitioner and Sri Habib Ahmad, learned counsel for the respondents No. 2 and 3.
The petitioner has filed this petition challenging the notice dated 29.10.2018 issued under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the Act) for realising sum of Rs.4,63,99,364/- plus interest and recovery charges.
In response to the said notice the petitioner is entitle to file objections. The period of limitation for filing the objections have not yet expired and it is contended that the objections have already been filed.
If that be so, let the matter be adjudicated by the authority concerned, even otherwise the petitioner can assail the aforesaid notice in proceedings under Section 17 of the Act.
In view of above alternative remedies, we do not deem it necessary to exercise our discretionary jurisdiction.
The Writ Petition is dismissed with liberties aforesaid.
