Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed challenging the impugned order dted 9.9.2019 passed by the respondent no. 3-Sub Divisional Magistrate, Bilari, District Moradabad.
By the impugned order, fair price shop licence of the petitioner has been suspended.
Petitioner may file his objection/reply to the show cause notice/suspension orer taking all such grounds that are being asserted before this Court and the respondent no. 3 is under obligation to consider and decide it.
Accordingly, without interfering in the impugned order, present petition stands disposed of with liberty to the petitioner to file his objection/reply to the show cause notice along with certified copy of this order before the respondent no. 3-Sub Divisional Magistrate, Bilari, District Moradabad who shall consider and decide the same, preferably within a period of one month from the date of filing of the objection/reply.
No order as to costs.
