Learned A.G.A. has accepted notice on behalf of respondent nos. 1 to 3.
Issue notice to respondent no. 4.
Each one of the respondents is accorded six weeks time to file counter affidavit. Rejoinder affidavit may be filed within next two weeks.
List thereafter alongwith the record of Criminal Misc. Writ Petition No. 9617 of 2010. On the next date name of respective counsel appearing in the aforesaid case be also shown in the cause list alongwith case title.
It has been stated on behalf of petitioner that in respect of this very criminal case, Smt. Renu Verma has preferred Criminal Misc. Writ Petition No. 9617 of 2010 and therein following interim order has been passed;
"Heard learned counsel for the petitioner and learned A.G.A. for respondents no. 1 and 2.
Issue notice to the respondent no. 3 returnable at an early date. Respondents are directed to file counter affidavit within four weeks. The petitioner shall have three weeks thereafter to file rejoinder affidavit.
List thereafter.
Till the filing of the charge sheet, the petitioner shall not be arrested in pursuance of F.I.R. dated 22.08.1998 in Case Crime No. 1159 of 1998, under Sections 120-B, 420, 467, 468, 471 I.P.C. and Section 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, Police Station-Kotwali Nagar, District Pratapgarh."
In such a situation till the next date of listing or till submission of report under Section 173 (2) Cr. P.C. whichever is earlier, petitioner shall not be arrested in Case Crime No. 1159 of 1998, under Sections 120-B, 420, 467, 468, 471 I.P.C. and Section 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, Police Station-Kotwali Nagar, District Pratapgarh subject to condition that petitioner shall extend all possible cooperation with the on going investigation.
