Heard Sri Brijesh Kumar Yadava, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
Against grant of license of fair price shop the petitioner being Pradhan had filed a case before this Court but the same was withdrawn. The petitioner now claims by means of this writ petition that the District Magistrate may permit the petitioner to engage special counsel to contest his case before this Court for which his representation dated 22.05.2018 is pending before him.
Learned counsel for the petitioner submits that such prayer is permissible under Section 73(2) of U.P. Revenue Code Act and Rule 75 of U.P. Revenue Code Rules 2016.
The writ petition is disposed of with the direction that in case such a representation is pending before the Collector, the same be considered and decided in accordance with law.
